Chapter 17E.010 Critical Aquifer Recharge Areas – Aquifer Protection

Article IV. Aboveground Storage Tanks

Section 17E.010.480 Spill Prevention and Protection

1. The options in subsection (B) of this section shall apply whenever the fire official finds:

1. 1. a violation of this article;

1. 2. reasonable cause exists to believe a spill or seepage is occurring (SMC 17A.020.180);

1. 3. a selected monitoring method is either not effectively monitoring leaks or discloses a leak or possible leak;

1. 4. other environmental risk.

2. Under any condition provided in subsection (A) of this section, the fire official may order any or all of the following:

1. 1. Further approved leak testing.

1. 2. Implementation of additional approved monitoring methods.

1. 3. Removal of AST contents.

1. 4. Cleanup of spills or seepage.

1. 5. AST reinforcement, modification, repair, or replacement in accordance with approved City standards.

1. 6. Prohibit further usage.

1. 7. Revoke or suspend a permit or impose restrictions or conditions on permit privileges.

1. 8. Additional or modified containment.

1. 9. Any other measure deemed reasonably necessary to protect the public health and safety or accomplish the purpose of this chapter.

3. If, in the opinion of the fire official, a leak or leak risk is created by corrosion or some other unknown cause, the tank and associated structures may be ordered removed from service and/or otherwise safeguarded.

4. This section shall not restrict any other municipal power or right.
