Chapter 17E.040 Spokane Geologically Hazardous Areas

Section 17E.040.050 Regulated Activities
  1. Regulated Uses and Activities Geologically Hazardous Areas.
    1. For the purposes of this chapter, the City of Spokane may restrict the regulated uses and activities that lie within a geologically hazardous area through the application of the performance standards contained in the Spokane Municipal Code.
    1. In cases where differences in regulations occur because of critical areas and associated buffers, the regulation that provides the greatest degree of protection shall apply.
    1. The City shall not approve any permit or otherwise issue any authorization to alter the condition of any land, water or vegetation, or to construct or alter any structure or improvement in, over or on a potential geologically hazardous area or associated buffer, without first ensuring compliance with the requirements of this chapter, including, but not limited to, those permits listed at chapter 17G.061 SMC and as follows:
      1. All clearing and grading, including fifty cubic yards or less of earth materials.

Note: Other uses and activities not listed are assumed to be subject to this ordinance unless otherwise determined by the director.

  1. Critical Areas Checklist Required.

A critical areas checklist must be submitted at the time of application for all regulated activities proposed in geologically hazardous areas and associated buffers as required at chapter 17G.061 SMC.
