Article IV. Shoreline Permits and Exemptions
Section 17E.060.310 Shoreline Conditional Use Permit
- Purpose.
To allow greater flexibility in administering the use and modification regulations of these shoreline regulations in a manner consistent with the policy of RCW 90.58.020. In authorizing a shoreline conditional use, special conditions may be attached to the permit by the City or the department of ecology to control any undesirable effects of the proposed use.
- Uses or modifications not listed in Table 17E.060.670-1, Table 17E.060.690-1, and Title 17C SMC may only be authorized as a shoreline conditional use.
- Uses which are identified in these shoreline regulations as requiring shoreline conditional use approval, and other uses which, although not expressly mentioned in lists of permitted uses, are permitted in the underlying zones and are not prohibited in the shoreline jurisdiction, may be approved, approved with conditions or denied by the hearing examiner in specific cases based on the criteria in SMC 17G.061.310, Decision criteria, as now constituted or hereafter amended, and any additional criteria given in these shoreline regulations. Upon transmittal of the hearing examiner’s decision to the department of ecology (ecology), the permit may be approved, approved with conditions, or denied by ecology.
