Article V. General Requirements for Shoreline Use and Modifications: Part IV. General Requirements for Shoreline Modifications
Section 17E.060.390 General Provisions
- All shoreline modifications in the shoreline jurisdiction shall be subject to the following general standards applicable to all environments, shall also meet the modification standards for the specific environment in which the modification is located (see Table 17E.060.670-1), and shall be subject to the standards of the underlying zone.
- Structural shoreline modifications shall be allowed only where they are demonstrated to be necessary to support or protect an allowed primary structure or a legally existing shoreline use that is in danger of loss or substantial damage or are necessary for reconfiguration of the shoreline for mitigation or enhancement purposes.
- Shoreline modifications individually and cumulatively shall not result in a net loss of ecological functions and shall avoid and reduce significant ecological impacts pursuant to SMC 17E.060.230, Mitigation Sequencing.
- Where an engineering/geotechnical analysis report is required, it shall be prepared by a qualified professional.
- Shoreline modifications, including dredging, fill, landfill, and shoreline stabilization measures, shall be considered to be uses not subject to variance.
