Chapter 18.07 Police Practices

Section 18.07.020 Immigration Status Information
  1. Unless required by law or court order, no officer, agent, or employee of the City of Spokane shall inquire into the immigration or citizenship status of any person, or engage in activities designed to ascertain the immigration status of any person.

  2. Spokane Police officers may not inquire into the immigration or citizenship status of an individual unless they have reasonable suspicion to believe a person: (i) has been previously deported from the United States, (ii) is again present in the United States, and (iii) is committing or has committed a felony criminal law violation.

  3. The Spokane Police Department shall not investigate, arrest, or detain an individual based solely on immigration or citizenship status.

  4. The Spokane Police Department shall maintain policies consistent with this section.
