Section 13.03.0608 Sewer Local Improvement District Waiver Agreement

 

1. Where an owner of property seeks to connect to the POTW, and the Wastewater Director determines either that lateral service is unavailable or that public sewer service is being provided on an interim basis, then such owner must obtain from the Development Services Director and execute, as a condition of connection, a sewer waiver agreement for a Local Improvement District (LID) sewer assessment.

2. Said agreement provides that the signatory:

1. 1. waives the right to protest the establishment of any Local Improvement District for the installation of a public sewer which may be proposed and/or to claim lack of benefit or less benefit than the amount of the assessment; and

1. 2. will join in any LID petition creating such district.

3. The owner records said agreement and pays all filing fees required for the recording of said agreement with the Spokane County Auditor.
