Title 13 Public Utilities and Services
Chapter 13.03A Pretreatment
Article II. General Requirements
Section 13.03A.0209 Deadline for Compliance with Applicable Pretreatment Standards [2.9]
- Compliance by existing sources covered by categorical pretreatment standards shall be within three years of the date the standard is effective unless a shorter compliance time is specified in the applicable standard, other provision, or Plant Manager order. The Plant Manager establishes a final compliance deadline for any existing user not covered by categorical pretreatment standards or any categorical user where state requirements or local limits are more restrictive.
- New sources and new users are required to comply with applicable pretreatment standards within the shortest feasible time, not to exceed ninety days from beginning of discharge. New sources and new users shall install, have in good operating condition, and shall start up all pollution control equipment (including sampling equipment) required to meet applicable pretreatment standards before beginning to discharge.
- Any discharge permit to a CIU shall not contain a compliance date beyond the deadline established in EPA categorical pretreatment standards. Not by way of limitation, other existing users or CIUs who must comply with more stringent state requirements or local limits shall be provided with a compliance deadline in their permit to insure compliance in the shortest feasible time, in the Plant Manager’s opinion.
