Chapter 17G.010 Building and Construction Permits

Section 17G.010.090 Cost of Enforcement
  1. In addition to the various permit, license, inspection and other application fees which are designed and intended to at least partially defray the cost of administration and which, therefore, are not refundable, except as provided in SMC 8.02.0692, the City declares its right and intention to claim reimbursement for extraordinary expenses incurred as a result of a person’s acts or omissions in violation of this code. The City may claim costs incurred in judicial proceedings and may claim against any public liability, indemnity, or performance insurance policy or bond.
     
  2. Whenever the City is reasonably required to cure defective work or a hazardous condition in or about a public way, the City may charge its costs and expenses against any owner of the abutting property or a contractor or other agent doing the work or creating the condition. To the extent that such work done by the City relieves the abutting property owner of potential liability, the City claims the right to file liens against such property pursuant to any laws conferring the right of lien on persons whose furnishing of labor or materials benefits the property of another.
     
  3. Notwithstanding any other ordinances or statutes providing for real property liens, the City’s cost of repairs, alterations, improvements, removal, demolition, vacating or closing unfit or unsafe buildings shall be assessed against the real property upon which the cost was incurred, and, when filed with the Spokane county treasurer become a part of the general taxes for that year, to be collected at the same time and with interest as provided by statute.
