Chapter 17G.010 Building and Construction Permits

Section 17G.010.240 Effect of Approval
  1. All applications and approvals under this title must be in writing. Approvals are based upon the application documents. No purported or alleged approval of a variance, deviation or substitution of the minimum performance standards of any law is effective unless expressly specified in the written approval. No modification of an approved application can be considered approved unless specifically provided in writing.
     
  2. An approval of an application that does not comply with governing law is wholly inoperative and confers no rights with respect to the noncompliance. Upon discovery of the noncompliance, the director rescinds the approval or, in appropriate cases, requires modification of the application and issues a modified approval.
     
  3. Except as to certifications of existing status which are required, such as certificates of occupancy, and except when action is required to be taken, such as by complaint under the building and property conservation code, applications under this title are for activities to be undertaken voluntarily and an approval hereunder permits, but does not require, that the proposal be done. An approval with conditions or standards requires that the action be taken, if at all, in compliance with the conditions and standards and not otherwise.
     
  4. Approvals under this title are given based on the requirements of this code. An approval does not warrant that the proposal complies with any other laws. An approval under this title does not purport to declare or affect contract or property rights as between private persons.
