Section 01.05.151 Civil Infraction Penalty Schedule
  1. It is the policy of the City of Spokane to educate and seek voluntary compliance for the code violations referenced in this chapter before issuing civil infractions or escalating penalties.
  1. Unless designated otherwise by local or state law, violations of the following Spokane Municipal Code chapters and sections are civil infractions subject to the monetary penalties and restitution prescribed by state law. Each and every such violation shall be a separate and distinct offense. In case of a continuing violation, every day's continuance shall be a separate and distinct violation.

Nuclear Weapons Free Zone

  1. If a violator is found to be a repeat offender, the violator will be subject to a penalty of $2,500 per violation in addition to the value of the underlying violation if the violation occurred on property whose permitted or primary use is residential as defined in SMC 17C.190.
  1. If a violator is found to be a repeat offender, the violator will be subject to a penalty of $5,000 per violation in addition to the value of the underlying violation if the violation occurred on property whose permitted or primary use is commercial, industrial, institutional, or other use as defined in SMC 17C.190.
  1. A repeat offender is defined as an owner and/or occupant of a private property who has one or more committed finding(s) for violation of the regulations set forth or referenced in this chapter, at the same site or on a different tax parcel under the same ownership or occupancy, two times within 12 months from the date of the current violation.
