Description of Project

Planned Unit Development Long Plat & Wetland Modification Conditional Use Permit (Type III)
The application proposes to subdivide 34.93 acres of land into a 199-lot Planned Unit Development (PUD) for development for single-family homes. The application also includes a Wetland Modification Conditional Use Permit (CUP). The application is requesting modification to the maximum FAR, lot coverage, driveway coverage limits, and front living space and rear yard setbacks under the PUD application process. This combine application is being processed as a Type III application requiring an application before the Hearing Examiner.

Hearing Examiner Decision and Notice of Right to Appeal

Appeals of decisions by the Hearing Examiner are governed by SMC 17G.061.340 and 17G.050.

Decisions of the Hearing Examiner regarding preliminary Type III Planned Unit Developments, Long Plats, and Conditional Use Permit Applications are final. They may be appealed to the City Council. All appeals must be filed with the Planning Department within fourteen (14) calendar days of the date of the decision. The date of decision is the 22nd of April, 2024.

The last day to appeal is the 6th day of May 2024 at 5 p.m.

In addition to paying the appeal fee to appeal the decision, the ordinance requires payment of a transcript fee to the City of Spokane to cover the costs of preparing verbatim transcript and otherwise preparing a full record for the City Council.

Notice of Application and Public Hearing

Any person may submit written comments on the proposal, call for additional information or participate in the hearing. Comments received by February 27, 2024, at 5 p.m. will be included in the project staff report. Written comments received by March 26, 2024, by 5 p.m. will be forwarded to the hearing examiner for inclusion in the project public record.

There will be a public hearing on this proposal before the City of Spokane Hearing Examiner on Wednesday, March 27, 2024, at 9:00 a.m. The hearing will be held in the Council Chambers, Lower Level of City Hall, 808 W. Spokane Falls Boulevard, Spokane, WA. Any person may submit written comments on the proposal and/or appear at the public hearing.

Only the applicant, persons submitting written comments, and persons testifying at a hearing may appeal the decision of the Hearing Examiner.

SEPA Review

The comment period for this SEPA ended on February 27, 2024. This Mitigated Determination of Non-significance (MDNS) was issued under 197-11-340(2). The lead agency will not act on this proposal for at least 14 days from the date of issuance. Appeal of this MDNS must be received within 14 calendar days after the signing of this MDNS. The SEPA MDNS is available for review.
