The applicant is proposing a preliminary plat and a planned unit development on approximately 24.59 acres for 236 residential units and about 38,000 square feet of office, retail and commercial uses.
Appeals of decisions by the Hearing Examiner are governed by SMC 17G.060.210, 19 17G.060.210.C, 17G.060.210.F, and 17G.050.
Decisions by the Hearing Examiner regarding preliminary long plats and PUDs are final. The Hearing Examiner's decision may be appealed to the Spokane City Council. All appeals must be filed with the Planning Department within fourteen (14) calendar days of the issuance of the decision.
Pursuant to Revised Code of Washington (RCW) Chapter 36.70C, the date of issuance of the Hearing Examiner's decision is three (3) days after it is mailed.
On January 15, 2019, a copy of this decision will be by first class mail to the Applicant, the Property Owner, and the Agent and by email or first class mail to other parties of record. The date of issuance of the Hearing Examiner's decision is January 18, 2019.
The last day for appeal of this decision to the Spokane City Council is February 1, 2019
In addition to paying the appeal fee to appeal the decision, the ordinance requires payment of a transcript fee to the Office of the Hearing Examiner to cover the costs of preparing a verbatim transcript and otherwise preparing a full record for the City Council. Pursuant to RCW 36.70B.130, affected property owners may request a change in valuation for property tax purposes notwithstanding any program of revaluation.
