Spokane Police responded to a call that originally came in involving a male with a gun in the 2200 block of N. Perry. After initially refusing to come out of his residence, officers were able to use de-escalation and negotiating techniques safely take 42-year-old Brian M. Drake into custody without further incident. He was booked into Spokane County Jail on charges of City Assault-Domestic Violence and Unlawful Possession of a Firearm.
On 6/12/14, just after 9:00 pm, officers responded the 2200 block of N. Perry on a report of an incident involving a male outside a residence with a gun. Officers arrived on scene within three minutes of the initial call and quickly determined the incident stemmed from a domestic violence assault involving a female inside the residence. By the time officers arrived, Drake had gone back inside the house. The female victim and another occupant of the residence were able to get out of the house and away from Drake.
Officers quickly determined they had enough information to arrest Drake on two charges (City Assault-Domestic Violence and Unlawful Possession of a Firearm), but he refused to come outside. After about 45 minutes of negotiating with him, he surrendered and was taken into custody without incident.
Officers executed a search warrant on the house and found the firearm and ammunition. Drake has one previous felony conviction for 2nd Degree Theft and is therefore prohibited from having a firearm. He will have his first appearance in court today at 1:30 pm.
