Tenant Defense

Under SMC 10.57.250, you may have a legal defense in an eviction case if:

  • Your landlord did not give you the required written notice of prevention resources; or
  • Your landlord did not participate in the prevention program in good faith before filing an eviction

These defenses do not apply if the landlord's eviction is exempt under SMC 10.57.240
