A level 3, Sexually Violent Predator, Released in Spokane Area

The Spokane County Sheriff’s Office and Spokane Police Department are extremely concerned about the release of 55-year-old David W. McCuistion, into the Spokane Community.

McCuistion was found to be a sexually violent predator in 2003 and held at the McNeil Island Corrections Center. He has a long history of substance abuse, sexually violent and violent acts to include convictions for Rape 3rd Degree, Assault 2nd, Assault 3rd, and subsequently civilly committed as a Sexually Violent Predator under Washington State RCW 71.09 on October 3, 2003.

In a recent decision, Pierce County Superior Court Judge James R. Orlando granted McCuistion’s release and allowing him to travel to and reside at the 300 block of West 2nd in Spokane against the objections of the Washington State Attorney General’s Office, Washington State Department of Social and Health Services and Washington State Department of Corrections as a Less Restrictive Alternative (LRA).

As a level 3 sex offender and sexually violent predator, McCuiston will be required to register as a sex offender with the Sheriff’s Office in addition to other court ordered requirements of release and monitoring by the Washington State Department of Corrections.

The Spokane County WA Sheriff's Office is releasing the following information pursuant to RCW 4.24.550, which authorizes law enforcement agencies to inform the public of a sex offender release when, in the discretion of the agency, the release of information will enhance public safety and protection.

The individuals who appear on such notifications have been convicted of a sex offense that requires registration with the Sheriff's Office in the county of their residence. Further, their previous criminal history places them in a classification level which reflects the potential to reoffend.

This individual has served the sentence imposed on them by the courts. HE/SHE IS NOT WANTED BY THE LAW ENFORCEMENT AT THIS TIME. THIS NOTIFICATION IS NOT INTENDED TO INCREASE FEAR; RATHER IT IS OUR BELIEF THAT AN INFORMED PUBLIC IS A SAFER PUBLIC.

Law Enforcement has no legal authority to direct where a sex offender may or may not live. Unless court ordered restrictions exist, this offender is constitutionally free to live wherever he/she chooses.
